Social Media Giveaways and Prize Draws

 

 1. About these terms

 

1.1 These terms apply to any free prize draw, through a social media platform (“Giveaway”).

 

1.2 The promoter of each Giveaway is the company identified as “we”, “us” or “our” in these Terms and Conditions, unless a different promoter or any joint promoters are identified in the relevant Giveaway post.

 

1.3 Each Giveaway will also be subject to any additional instructions, eligibility requirements and promotion-specific terms stated in the relevant social media post (“Giveaway Post”).

 

1.4 By entering a Giveaway, entrants agree to be bound by:

 

·      these Social Media Giveaway Terms;

·      the relevant Giveaway Post; and

·      the applicable terms and policies of the social media platform through which the Giveaway is operated.

 

1.5 Where there is a conflict between these terms and the Giveaway Post, the Giveaway Post will take priority in relation to that particular Giveaway, provided the relevant condition was clearly communicated before or at the time of entry.

 

 2. Eligibility

 

2.1 Unless the Giveaway Post states otherwise, Giveaways are open to residents of the United Kingdom who are aged 18 or over at the time of entry.

 

2.2 Giveaways are not open to:

 

·      our employees, officers or directors;

·      employees of any company involved in administering or supplying the Giveaway; or

·      anyone professionally connected with the Giveaway.

 

2.3 Entrants must have a genuine and valid account on the relevant social media platform and must comply with that platform’s terms of use.

 

2.4 We may request reasonable evidence of an entrant’s age, identity, address or eligibility before awarding a prize.

 

 3. How to enter

 

3.1 Each Giveaway Post will state:

 

·      how to enter;

·      the opening and closing date and time;

·      any age or geographical restrictions;

·      the number and nature of the prizes;

·      the number of winners; and

·      any limit on the number of entries permitted.

 

3.2 Entry is free and no purchase is necessary, unless the Giveaway Post expressly states otherwise and an appropriate legally compliant entry structure is provided.

 

3.3 Entrants must complete all entry requirements stated in the Giveaway Post. This may include following an account, liking a post, leaving a comment, answering a question or tagging another social media account.

 

3.4 Entrants must not tag themselves or another person inaccurately in any photograph or other content.

 

3.5 Unless stated otherwise, only one entry per person and per social media account is permitted. Duplicate entries may be removed.

 

3.6 Entries submitted after the stated closing date and time will not be accepted.

 

3.7 Entries made through agents, third parties, automated services, scripts, bots, bulk-entry services or multiple fake accounts will not be accepted.

 

3.8 We accept no responsibility for entries that are incomplete, incorrectly submitted, delayed, corrupted or not received because of a technical fault, platform outage, equipment failure or network failure, except where caused by our breach of these terms.

 

3.9 Proof that an entry was submitted does not necessarily constitute proof that it was successfully received.

 

 4. Prizes

 

4.1 The number, description and, where appropriate, approximate retail value of each prize will be stated in the Giveaway Post.

 

4.2 Prizes are subject to availability, are non-transferable and cannot be exchanged for cash.

 

4.3 We will not require a winner to pay a fee or incur a charge in order to claim their prize.

 

4.4 If a prize becomes unavailable because of circumstances beyond our reasonable control, we may substitute it with a reasonable alternative of equal or greater value.

 

4.5 Unless expressly stated otherwise, the prize includes standard delivery to a valid UK address. Any costs, expenses or arrangements not expressly included in the prize are the responsibility of the winner.

 

4.6 Product images used in a Giveaway Post are for illustrative purposes. Minor differences in packaging, presentation, colour or finish may occur, provided that they do not materially reduce the nature or value of the advertised prize.

 

4.7 A prize may not be sold, transferred or advertised for commercial resale before it has been received by the winner.

 

 5. Winner selection

 

5.1 Unless the Giveaway Post expressly states that entries will be judged according to stated criteria, the winner will be selected at random from all valid and eligible entries received before the closing date.

 

5.2 Random selections will be conducted using a computer process capable of producing verifiably random results or under the supervision of an independent person.

 

5.3 We will retain reasonable evidence showing how the winner was selected.

 

5.4 Where a Giveaway is based on skill, creativity, knowledge or judgement, the Giveaway Post will explain:

 

·      the judging criteria;

·      how entries will be assessed; and

·      whether an independent judge or judging panel will be used.

 

 6. Notification and claiming the prize

 

6.1 Unless the Giveaway Post states otherwise, the winner will normally be selected and contacted within seven days of the Giveaway closing.

 

6.2 The winner will be contacted using the social media account, email address or other contact details used to enter. We may also announce that a winner has been selected through the relevant social media account.

 

6.3 Entrants should only trust communications from our official social media accounts or official company email addresses. We will not request payment, bank card details or a fee in order to release a prize.

 

6.4 Unless the Giveaway Post states otherwise, the winner must respond within seven days of our initial notification and provide the information reasonably required to confirm their eligibility and arrange delivery.

 

6.5 We will make reasonable attempts to contact the winner. If the winner:

 

·      does not respond within the stated period;

·      cannot be contacted after reasonable attempts;

·      is not eligible;

·      fails to provide the information reasonably required;

·      declines the prize; or

·      is found to have breached these terms,

 

we may withdraw the prize and select an alternative winner using the same selection method.

 

6.6 The prize will normally be dispatched within 30 days of the winner supplying the required delivery information, unless a different delivery timescale is stated in the Giveaway Post.

 

6.7 We are not responsible for a prize being delayed or undeliverable because the winner provided incorrect, incomplete or out-of-date delivery information.

 

 7. Winner information

 

7.1 To demonstrate that a valid prize award has taken place, we may publish or make available limited information about the winner. This will ordinarily be the winner’s surname and county, social media username or other limited identifying information stated in the Giveaway Post.

 

7.2 Entrants may object to the publication of this information or request that the amount of information published is reduced by contacting us.

 

7.3 Where a winner objects, we may still provide the winner’s details and evidence of the prize award to the Advertising Standards Authority or another relevant regulatory body where required.

 

7.4 We will not require a winner to participate in additional publicity unless this was clearly stated before entry or the winner separately agrees to do so.

 

 8. Personal information

 

8.1 We will use entrants’ personal information only as reasonably necessary to:

 

·      administer the Giveaway;

·      verify eligibility;

·      contact the winner;

·      deliver the prize;

·      prevent fraud or misuse; and

·      comply with our legal and regulatory obligations.

 

8.2 Personal information will be handled in accordance with our Privacy Policy.

 

8.3 We may share the winner’s details with delivery companies, prize suppliers, fulfilment providers or other service providers where reasonably necessary to provide the prize.

 

8.4 Entering a Giveaway does not automatically subscribe an entrant to marketing communications. We will only use an entrant’s information for electronic marketing where we have a separate lawful basis or the entrant has actively chosen to receive it.

 

8.5 The relevant social media platform may separately collect and process entrants’ information under its own privacy policy. We are not responsible for the platform’s independent use of that information.

 

 9. Entries containing photographs, text or other content

 

9.1 Where a Giveaway requires entrants to submit photographs, videos, written material, designs or other content, entrants confirm that:

 

·      the content is their own original work or they have permission to use it;

·      the content does not infringe another person’s intellectual property, privacy or other rights;

·      anyone identifiable in the content has consented to its submission and permitted use;

·      the content is not defamatory, discriminatory, threatening, obscene or unlawful; and

·      the content does not contain confidential information.

 

9.2 Entrants retain ownership of their content but grant us a non-exclusive, royalty-free licence to reproduce, display and share it for the purpose of administering and reasonably publicising the Giveaway.

 

9.3 Any wider or ongoing advertising use of an entrant’s content will be subject to any additional permissions stated in the Giveaway Post or separately agreed with the entrant.

 

 10. Disqualification

 

10.1 We may reject an entry or disqualify an entrant where we reasonably believe that the entrant has:

 

·      breached these terms or the Giveaway Post;

·      provided false or misleading information;

·      used multiple, fake or automated accounts;

·      attempted to manipulate the entry or selection process;

·      interfered with the operation of the Giveaway;

·      engaged in abusive, threatening or fraudulent behaviour; or

·      breached the rules of the relevant social media platform.

 

10.2 A prize may only be withheld where there is a genuine and justifiable reason, including where the winner did not meet an eligibility or entry requirement that was clearly communicated before entry.

 

 11. Changes, suspension and cancellation

 

11.1 We will not normally change the closing date, entry method, prize or other material conditions after a Giveaway has begun.

 

11.2 We may suspend, amend or cancel a Giveaway where this is reasonably necessary because of circumstances beyond our control, including serious technical failure, platform disruption, fraud, legal restrictions or an event affecting our ability to provide the advertised prize.

 

11.3 Any changes will be communicated through the relevant social media account and will be designed, so far as reasonably possible, not to unfairly disadvantage entrants who have already entered.

 

 12. Liability

 

12.1 Nothing in these terms excludes or limits liability for:

 

·      death or personal injury caused by negligence;

·      fraud or fraudulent misrepresentation;

·      a breach of rights that cannot legally be excluded; or

·      any other liability that cannot be excluded under applicable law.

 

12.2 Subject to clause 12.1, we will not be responsible for losses that were not reasonably foreseeable when the entrant entered the Giveaway or for losses relating to an entrant’s business, trade or profession.

 

12.3 We are not responsible for any action, omission, outage, restriction or account suspension imposed by a social media platform.

 

12.4 Nothing in these terms affects a winner’s statutory rights in relation to a product supplied as a prize.

 

 13. Social media platforms

 

13.1 Unless expressly stated otherwise, each Giveaway is in no way sponsored, endorsed, administered by or associated with Instagram, Facebook, TikTok, X or any other social media platform on which it is promoted.

 

13.2 By entering, entrants acknowledge that the relevant social media platform has no responsibility for the Giveaway and release that platform from claims connected with the Giveaway to the fullest extent permitted by law.

 

13.3 Questions, comments and complaints about a Giveaway must be directed to us and not to the social media platform.

 

 14. Our decisions

 

14.1 Our decisions concerning the administration of a Giveaway are final, subject to applicable law and the rights of entrants to raise a legitimate complaint.

 

14.2 Nothing in this clause prevents an entrant from contacting the Advertising Standards Authority, a consumer protection body or another relevant regulator.

 

 15. Governing law

 

15.1 These terms and each Giveaway are governed by the laws of England and Wales.

 

15.2 Entrants living in Scotland or Northern Ireland will retain any mandatory rights available under the laws of their home jurisdiction and may bring proceedings in their local courts where applicable.
